Terms and Conditions

Effective Date: 2026-01-01

These Terms and Conditions apply to all tours, travel packages, transportation services, accommodation arrangements, activities and other travel-related services booked through Sunbriz Holidays & Events Sdn. Bhd. (Company Registration No. 201001000891 / 0885463-H), referred to in these Terms and Conditions as “Sunbriz”, “we”, “us” or “our”.

By making a reservation, submitting payment or participating in a tour, the customer and all persons included in the booking agree to these Terms and Conditions.

1. Reservations and Booking Confirmation

1.1 All reservations are subject to availability.

1.2 A reservation is not considered confirmed until the required deposit or full payment has been successfully received, cleared and verified by Sunbriz.

1.3 Customers are responsible for ensuring that all information submitted during booking is complete and accurate, including:

  • Full name as shown on the passport or identification document;
  • Passport or identification number;
  • Nationality;
  • Contact information;
  • Travel date;
  • Number of travellers;
  • Selected package; and
  • Any dietary, medical, mobility or other special requirements.

1.4 The booking confirmation, quotation, invoice or payment receipt issued by Sunbriz will form part of the booking agreement.

1.5 Additional conditions that apply to a particular tour, accommodation, ticket, activity or third-party service will be stated in the relevant quotation, booking confirmation or invoice.

2. Tour Prices and Payments

2.1 All prices are quoted in Malaysian Ringgit unless otherwise stated.

2.2 Tour prices include only the services specifically listed under the package inclusions. Any item not stated as included will be treated as an additional expense payable by the customer.

2.3 Deposits and outstanding balances must be paid by the payment deadline stated in the quotation, invoice or booking confirmation.

2.4 If payment is not received by the stated deadline, Sunbriz may cancel the reservation automatically without further notice. Any deposit already paid may be non-refundable, subject to the cancellation conditions and costs incurred for the booking.

2.5 Payments must be made in the exact amount stated in the invoice or booking confirmation. Any verified overpayment may be retained as booking credit or handled according to a separate written arrangement between Sunbriz and the customer.

2.6 Bank charges, currency conversion fees, card processing fees or other transaction charges are the responsibility of the customer unless otherwise stated.

3. Taxes and Government Charges

3.1 Tour prices are based on the taxes, fees and government charges applicable at the time the quotation is issued.

3.2 If any Malaysian government authority or other relevant authority introduces, removes or changes a tax, tourism fee, accommodation charge, service charge, entrance fee or similar mandatory payment, Sunbriz reserves the right to adjust the total booking price accordingly.

3.3 Any additional mandatory charge imposed after booking must be paid by the customer before departure or when requested.

4. Travel Documents and Entry Requirements

4.1 Customers are responsible for obtaining and carrying all required travel documents, including:

  • Valid passports;
  • Identification documents;
  • Visas;
  • Entry permits;
  • Vaccination or health certificates;
  • Travel insurance documents; and
  • Any other document required by the relevant authorities.

4.2 Passports should have at least six months’ validity from the travel date where required by the destination, immigration authority or service provider.

4.3 Sunbriz will not be responsible if a customer is refused entry, boarding or participation because of incomplete, invalid, expired or incorrect travel documents.

4.4 Any expenses resulting from immigration refusal, deportation, document problems or failure to meet entry requirements must be borne by the customer.

5. Health, Fitness and Special Requirements

5.1 Customers must ensure that they are medically and physically fit to participate in the selected tour and activities.

5.2 Customers must inform Sunbriz during booking of any:

  • Medical condition;
  • Physical disability;
  • Mobility limitation;
  • Allergy;
  • Dietary restriction;
  • Pregnancy;
  • Medication requirement; or
  • Other condition requiring special attention.

5.3 Sunbriz will make reasonable efforts to accommodate disclosed requirements but cannot guarantee that every request can be fulfilled.

5.4 If relevant information is not disclosed before departure, Sunbriz may refuse or discontinue the customer’s participation where participation may affect safety, operations or the experience of other travellers.

5.5 No refund will be provided where participation is refused or discontinued because the customer failed to disclose an existing condition or requirement.

5.6 Pregnant travellers should obtain written medical confirmation that they are fit to travel. Participation remains subject to the rules of airlines, ferry operators, boat operators, cruise companies, accommodation providers and activity operators.

5.7 Where a third-party provider refuses participation because of pregnancy, health, age, weight, mobility or safety restrictions, refunds will be subject to that provider’s applicable policy.

6. Travel Insurance

6.1 Customers are strongly encouraged to purchase comprehensive travel insurance before departure.

6.2 Recommended coverage includes:

  • Trip cancellation or interruption;
  • Medical treatment;
  • Personal accident;
  • Emergency evacuation;
  • Lost or damaged baggage;
  • Travel delays;
  • Missed transportation connections; and
  • Personal liability.

6.3 Sunbriz is not responsible for losses that could have been covered by an appropriate travel insurance policy.

7. Tour Itineraries and Schedule Changes

7.1 Tour itineraries, transportation schedules, accommodation arrangements and activity times are subject to change.

7.2 Sunbriz may modify, rearrange, replace or omit any part of an itinerary when reasonably necessary due to:

  • Weather conditions;
  • Safety concerns;
  • Road or traffic conditions;
  • Operational requirements;
  • Attraction closures;
  • Government restrictions;
  • Transportation delays or cancellations;
  • Insufficient availability;
  • Natural disasters;
  • Public health events; or
  • Other circumstances beyond our reasonable control.

7.3 Where possible, Sunbriz will arrange a suitable alternative of a reasonably similar standard. However, an exact replacement cannot be guaranteed.

7.4 Changes made to protect the safety of travellers or respond to circumstances beyond our reasonable control will not automatically entitle customers to a full or partial refund.

7.5 Travel durations shown on the website or itinerary are estimates and may be affected by traffic, weather, immigration procedures, operational conditions and other circumstances.

8. Transportation Delays and Cancellations

8.1 Transportation schedules are controlled by the relevant airline, ferry company, cruise operator, bus company, railway operator or other transportation provider.

8.2 Transportation providers may delay, reschedule or cancel services due to weather, technical issues, operational requirements, safety concerns or other unforeseen circumstances.

8.3 Sunbriz will inform affected customers within a reasonable period after receiving confirmed information from the relevant provider.

8.4 Unless otherwise agreed in writing, Sunbriz will not be responsible for additional expenses arising from a transportation delay, cancellation or schedule change, including:

  • Additional accommodation;
  • Meals;
  • Replacement transportation;
  • Missed activities;
  • Additional tickets; or
  • Personal expenses.

8.5 Refunds for cancelled or changed transportation services will be subject to the terms and refund policies of the relevant transportation provider.

9. Unused Services

9.1 No refund or reduction will be provided for any service voluntarily unused by a customer, including unused:

  • Accommodation;
  • Meals;
  • Transportation;
  • Entrance tickets;
  • Activities;
  • Tour guide services; or
  • Other package inclusions.

9.2 This includes unused services resulting from:

  • Late arrival;
  • Early departure;
  • Illness;
  • Personal preference;
  • Failure to appear;
  • Failure to follow the itinerary;
  • Immigration issues; or
  • Changes to the customer’s personal travel arrangements.

10. Cancellation by the Customer

10.1 All cancellation requests must be submitted in writing to Sunbriz.

10.2 The cancellation date will be the date on which Sunbriz receives the written request, not the date on which the customer sends it.

10.3 Unless different cancellation conditions are stated in the quotation, booking confirmation or invoice, the following charges will apply:

90 days or more before departure RM200 per person or 20% of the total tour fare, whichever is higher
61–89 days before departure 50% of the total tour fare
36–60 days before departure 70% of the total tour fare
35 days or less before departure 100% of the total tour fare

10.4 A failure to attend the tour without prior written cancellation will be treated as a no-show and will incur a cancellation charge of 100% of the tour fare.

10.5 Non-refundable or already-confirmed third-party services may remain fully chargeable, including:

  • Flight tickets;
  • Ferry or transportation tickets;
  • Accommodation;
  • Attraction tickets;
  • Permits;
  • Event tickets;
  • Special meals; and
  • Private or customised arrangements.

10.6 Where a third-party provider imposes a cancellation charge higher than the standard charges shown above, the applicable supplier charge may be passed on to the customer if it was disclosed in the quotation, booking confirmation or invoice.

11. Cancellation Due to Exceptional Circumstances

11.1 Customers requesting cancellation because of exceptional circumstances must provide written notice together with supporting documents.

11.2 Circumstances that may be considered include:

  • Serious illness or hospitalisation;
  • Death of an immediate family member;
  • Compulsory government duty; or
  • Other comparable circumstances outside the customer’s reasonable control.

11.3 Each request will be reviewed individually. Submission of supporting documents does not guarantee approval, a waiver of cancellation fees or a full refund.

11.4 Any refund or reduction approved by Sunbriz will remain subject to:

  • Third-party supplier policies;
  • Non-refundable bookings;
  • Administrative costs;
  • Services already provided; and
  • Expenses already incurred for the reservation.

12. Booking Amendments

12.1 Requests to change a travel date, traveller name, package, accommodation, activity or other booking detail must be submitted in writing.

12.2 All changes are subject to availability and approval by Sunbriz and the relevant service providers.

12.3 Customers must pay any:

  • Difference in package price;
  • Supplier amendment fee;
  • Administrative fee;
  • Cancellation charge; or
  • Additional cost resulting from the requested change.

12.4 A date or traveller change may be treated as a cancellation and new booking where the relevant service provider does not permit amendments.

13. Third-Party Service Providers

13.1 Sunbriz may arrange services supplied by independent third parties, including hotels, restaurants, guides, drivers, transportation operators, attraction operators and activity providers.

13.2 Third-party services are subject to the provider’s own operational, safety, cancellation and refund conditions.

13.3 Sunbriz does not directly control the day-to-day operations of independent third-party providers.

13.4 To the fullest extent permitted by law, Sunbriz will not be responsible for loss, damage, delay or additional expense resulting from the acts, omissions, failures or changes of an independent provider, except where the loss was directly caused by Sunbriz and liability cannot lawfully be excluded.

14. Customer Conduct and Safety

14.1 Customers must follow all reasonable instructions given by the tour guide, driver, activity provider or Sunbriz representative.

14.2 Customers must behave respectfully toward other travellers, employees, local communities and service providers.

14.3 Sunbriz may remove a customer from a tour without a refund if the customer:

  • Creates a safety risk;
  • Behaves violently, abusively or unlawfully;
  • Causes serious disruption;
  • Damages property;
  • Is under the excessive influence of alcohol or prohibited substances; or
  • Refuses to follow reasonable safety instructions.

14.4 The customer will be responsible for any damage, loss, fine, penalty or expense caused by their actions.

15. Personal Belongings

15.1 Customers are responsible for safeguarding their money, passports, travel documents, electronic devices, luggage and personal belongings.

15.2 Sunbriz will not be responsible for lost, stolen or damaged personal property unless the loss was directly caused by Sunbriz and liability cannot legally be excluded.

15.3 Lost property recovered during a tour may be returned at the customer’s expense.

16. Limitation of Liability

16.1 Sunbriz will exercise reasonable care when arranging and providing travel services.

16.2 To the fullest extent permitted by applicable law, Sunbriz will not be liable for loss, delay, injury, illness, damage or expense caused by:

  • Events beyond our reasonable control;
  • Acts or omissions of independent service providers;
  • A customer’s own actions or negligence;
  • Undisclosed health or mobility conditions;
  • Invalid or incomplete travel documents;
  • Government or immigration decisions; or
  • Failure to follow safety instructions.

16.3 Nothing in these Terms and Conditions excludes or restricts any liability that cannot legally be excluded under Malaysian law.

16.4 Sunbriz will not be liable for indirect, incidental, special, punitive or consequential loss, including loss of enjoyment, income, opportunity or profit, except where such liability cannot lawfully be excluded.

17. Events Beyond Our Reasonable Control

17.1 Sunbriz will not be considered in breach of its obligations where services are delayed, changed or prevented by circumstances beyond our reasonable control.

17.2 Such circumstances may include:

  • Severe weather;
  • Floods, fires or natural disasters;
  • Epidemics or pandemics;
  • War, terrorism or civil unrest;
  • Government restrictions;
  • Border closures;
  • Strikes;
  • Transportation disruption;
  • Attraction closures;
  • Power or communication failures; or
  • Other unavoidable or extraordinary events.

17.3 Any refund, credit or alternative arrangement offered in these circumstances will depend on the recovery of funds from the relevant providers and the terms stated in the booking confirmation.

18. Promotions and Special Offers

18.1 Promotional prices are valid only for bookings made and confirmed within the stated promotional period.

18.2 Promotions are subject to availability and may include separate booking, travel, payment and cancellation conditions.

18.3 Bookings confirmed before or after the promotional period are not entitled to retrospective promotional pricing.

18.4 Requests to match a later promotional price will not be accepted unless otherwise approved by Sunbriz in writing.

18.5 Promotional offers cannot be combined unless expressly stated.

19. Electronic Documents and Communications

19.1 Customers agree that booking confirmations, invoices, receipts, notices and other documents may be issued electronically.

19.2 Customers are responsible for providing a valid email address and telephone number and for checking communications received from Sunbriz.

19.3 Electronic invoices and booking documents will be treated as valid records of the transaction.

20. Website Information

20.1 Sunbriz makes reasonable efforts to ensure that tour descriptions, photographs, prices and availability displayed on the website are accurate.

20.2 Photographs are provided for illustration and may not represent the exact vehicle, room, meal, attraction condition or experience provided.

20.3 Where a pricing, description or technical error is identified before confirmation, Sunbriz may correct the information and provide the customer with the option to accept the corrected booking or receive a refund of the affected payment.

21. Complaints

21.1 Any issue arising during a tour should be reported immediately to the assigned guide or Sunbriz representative so that reasonable efforts can be made to resolve it.

21.2 Complaints submitted after the tour must be provided in writing together with the booking details, supporting documents and relevant evidence.

21.3 Customers should submit post-tour complaints within 14 days after completion of the affected service to allow the matter to be investigated effectively.

22. Entire Agreement

22.1 These Terms and Conditions, together with the applicable quotation, invoice, booking confirmation and package-specific conditions, constitute the agreement between Sunbriz and the customer.

22.2 These documents replace any previous verbal or written discussion relating to the same booking.

22.3 If there is any inconsistency, the package-specific terms stated in the latest booking confirmation or invoice will apply to that booking, followed by these general Terms and Conditions.

22.4 Any exception or amendment must be confirmed by Sunbriz in writing.

23. Governing Law

23.1 These Terms and Conditions are governed by the laws of Malaysia.

23.2 Any dispute will be subject to the jurisdiction of the courts or relevant consumer dispute resolution bodies in Malaysia, unless otherwise required by applicable law.
